Booking Terms and Conditions

A   Definitions, applications and compliance notice

  1. “Bramber Cottage” shall mean the land and improvements thereon situated at 45 Queen Victoria Street, Stanford, Western Cape, South Africa and shall as far as may be applicable include the registered owner and management thereof.
  2. “Guest/s” shall mean the “Booking Guest”, whether personally benefitting from occupation in terms of the booking or not, and all beneficiaries of occupation emanating from a confirmed booking, for the duration of the booking.
  3. “Booking Guest” shall mean the person making the booking on the website of Bramber Cottage, regardless of whether the booking is made for that person or for and on behalf of other specified persons.
  4. “Delivery” shall mean delivery via electronic mail.
  5. “Applicable Currency” all rates quoted herein below are and all payments made to Bramber Cottage shall be in South African Rand.
  6. “Payment method” all payments made to Bramber Cottage in respect of bookings shall be made by means of electronic fund transfer to a bank account designated for this purpose by Bramber Cottage, on invoices rendered to Guests.
  7. “Applicable Law” South African Law shall exclusively apply to the interpretation and enforcement of and adjudication upon these terms and conditions, the latter of which shall be in a competent South African Court with jurisdiction over the magisterial district of Hermanus.
  8. “POPIA” Bramber Cottage complies with South African law and recognises the constitutional rights to privacy of any person, wherefore the protection of personal information of all Guests dealt with is of the utmost importance to us.  Guests are assured that Bramber Cottage incorporate the requirements of the Protection of Personal Information Act, 4 of 2013 into the daily operation of a guest house and ensures that requirements are implemented.  Bramber Cottage shall use personal information obtained from guests only for the purposes it was collected and agreed upon with Guests.

B   Booking Terms and Conditions

  • The Booking Guest, by making the booking, warrants that all persons to benefit from the booking, inclusive of the Booking Guest and, in the case of minors their parents and/or lawful guardians, are fully acquainted with these terms and conditions and accept that the booking shall be subject to adherence thereto.
  • The making of a booking by the Booking Guest and the acceptance thereof by Bramber Cottage constitute implementation of the terms and conditions and the acceptance thereof by the Guests, explicitly inclusive of section A above.
  • All bookings are strictly subject to availability.

C  Rates 2023 / 2024

LOW SEASON –  1 May 2023 to 30 September 2023 – R 1 800.00 per night (Minimum 2 nights’ stay during low and high season)

HIGH SEASON –  1 October 2023 to 30 April 2024 –   R 2 200.00 per night (Minimum 2 nights stay with exception of Peak season where the minimum stay is 5 nights)

PEAK SEASON – 16 December 2023 to 7 January 2024; and  26 April 2024 to 5 May 2024  – R 2 500.00 per night (Maximum 14 Nights’ stay during all periods)

D   Deposit & Payment Policy

  • A 50% deposit of the full currency value of the booking becomes due and payable on confirmation of the booking and the delivery of an invoice by Bramber Cottage.
  • The outstanding balance of the currency value of the booking becomes due and payable no later than 7 days prior to the Guests’ check-in date.
  • For bookings made within 7 days of the check-in date, the full currency value of the booking becomes due and payable upon delivery of an invoice by Bramber Cottage.

E   Cancellation Policy

If a booking is cancelled by Bramber Cottage, all payments by the Guest shall be refunded in full.

If a booking is cancelled by the Guest, the following refund policy will apply:

  • Full refund for cancellation NOT later than 30 days before check-in, subject to clause 2.4;
  • 50% refund for cancellation later than 30 days before check-in, but NOT later than 14 days before check-in, subject to clause 2.4;
  • NO refund will be made for cancellation after 14 days before check-in;
  • For bookings made fewer than 30 days before check-in, a full refund will apply if cancellation is made within 48 hours of the booking AND is made at least 14 days before check-in.

F   House Rules

  • Maximum occupancy of 5 persons, including children.
  • Guests must respect our neighbours and keep noise levels at an objectively acceptable level.
  • Quiet time strictly 22h00 to 08h00.
  • Parties and events are not allowed.
  • No smoking or vaping inside the cottage.
  • No pets allowed.

G   Swimming Pool

  • The swimming pool is unfenced and unsupervised, wherefore children should be supervised by their parents and/or guardians at all times.
  • Guests use the swimming pool strictly at their own risk.
  • No glass bottles or glasses are allowed in or close to the swimming pool.
  • Pool users are requested to always maintain decorum.

H   General Indemnity & Disclaimer

Whilst every care has and will be taken by Bramber Cottage to ensure the safety of Guests and their property during their stay, Bramber Cottage do not assume any risk or liability and cannot be held liable for any loss of, damage to or destruction of property of Guests, and injuries to or loss of life of Guests, or their visitors, of whatsoever kind, nature, value or degree, and arising from any cause whatsoever, including negligent acts or omissions on the part of Bramber Cottage, but excluding gross negligence.

By making the booking, Guests indemnify and hold harmless Bramber Cottage of any claims arising from the premises of the aforesaid.

I    Non-Variation

No variation of these terms and conditions by any person or entity shall be binding on Bramber Cottage or Guests, unless such variation or varied terms and conditions are published by Bramber Cottage on its website, with effect from date of such publication.

No indulgence by Bramber Cottage of Guests’ non-compliance with these terms and conditions, or relaxation of these terms and conditions by Bramber Cottage, shall be deemed to constitute a variation of the terms and conditions, or novation thereof, or create any new rights or obligations, or be legally binding on Bramber Cottage in any manner whatsoever.
